These General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions”, govern the online sale of the WordPress plugin Immo-Agence, sold on the website wp-propertykit.com by Webdesign-oi.com, operated by the company SEXYRUN.
The Immo-Agence plugin is a digital product designed for WordPress. It allows, among other features, the management and display of real estate listings, with search engines, property pages, carousels, notaries/offices, appearance settings, licensing and updates.

Article 2 — Purpose
These Terms and Conditions define the conditions under which the customer purchases, downloads, installs and uses the WordPress plugin Immo-Agence.
The plugin is provided as a downloadable digital file. No physical medium is delivered.
Depending on the offer selected, the purchase of the plugin gives access to:
- the plugin download;
- a license key;
- license activation on one or more websites according to the offer displayed at the time of purchase;
- updates during the validity period of the license;
- technical support according to the conditions set out in these Terms and Conditions.
Article 3 — Plugin Description
Immo-Agence is a WordPress plugin intended for professionals who wish to manage and display real estate listings.
The plugin may include, among other features:

- real estate taxonomies such as property types, offers and locations;
- display shortcodes;
- search engines;

Article 4 — Customers Concerned
The plugin may be purchased by:
- a professional customer;
- a web agency;
- a real estate agency;
- a notary or notarial office;
- a WordPress website administrator;
- a private individual, when sales are open to consumers.
The customer declares that they have the legal capacity required to place an order.
Article 5 — Technical Requirements
The customer acknowledges that use of the plugin requires a compatible technical environment.
Unless otherwise stated on the product page, the customer must have:
- a functional WordPress website;
- WordPress administrator access;
- hosting compatible with WordPress;
- a PHP version compatible with WordPress and the plugin;
- a properly developed WordPress theme;
- the necessary extensions if certain features depend on them.
The Seller cannot be held liable for any malfunction caused by:
- misconfigured hosting;
- an incompatible theme;
- a conflict with a third-party plugin;
- modification of the plugin code by the customer or a third party;
- incorrect installation;
- an outdated version of WordPress, PHP or MySQL;
- a handling error by the customer.
Article 6 — Prices
Prices are displayed on the website wp-propertykit.com at the time of order.
Prices may be displayed:
- excluding taxes;
- including all taxes;
- with VAT applicable according to the tax situation of the Seller and the customer.
The applicable price is the price displayed at the time the order is confirmed.
The Seller reserves the right to change prices at any time. A price change does not apply to orders already confirmed.
Article 7 — Order
The customer places the order directly on the website wp-propertykit.com.
Before confirming the order, the customer must check:
- the selected product;
- the price;
- their billing information;
- their email address;
- the selected license offer;
- these Terms and Conditions.
Confirmation of the order implies full and complete acceptance of these Terms and Conditions.
Article 8 — Payment
Payment is made online using the payment methods offered on the website.
The order is considered final after payment has been confirmed.
In the event of payment refusal, banking error, abusive dispute or suspected fraud, the Seller reserves the right to suspend access to the download, license, support and updates.
Article 9 — Digital Delivery

Article 10 — License of Use

The customer receives only a personal, non-exclusive, non-transferable right of use, which may be revoked in the event of non-compliance with these Terms and Conditions.

The customer is prohibited from:
- reselling the plugin on its own;
- redistributing the plugin ZIP file;
- publicly sharing the license key;

- bypassing the licensing system;
- removing or modifying the license verification mechanisms;
- presenting the plugin as their own creation;
- using the plugin for illegal or fraudulent purposes.
Article 11 — License Duration and Renewal
The license is valid for the duration indicated on the product page at the time of purchase.
Unless otherwise stated, the license provides access to updates and support for one year from the date of purchase.
When the license expires:
- the already installed plugin may continue to work according to the installed version;
- access to new updates may be suspended;
- access to support may be suspended;

Article 12 — Updates
Updates may include:

The Seller does not guarantee that all specific customer requests will be included in updates.
The customer is responsible for making a full backup of their website before any update.
Article 13 — Technical Support
Technical support applies only to the Immo-Agence plugin.
Technical support may include:
- installation assistance;
- license activation assistance;
- help using the planned features;
- analysis of a bug related to the plugin;
- general configuration assistance.
Technical support does not include, unless an additional service has been accepted by quotation:
- the full creation of a WordPress website;
- advanced graphic customization;
- development of custom features;
- fixing a third-party theme;
- fixing a conflict caused by a third-party plugin;
- website migration;
- recovery of a hacked website;
- direct intervention on the customer’s hosting.
Article 14 — Right of Withdrawal for Consumer Customers
In accordance with the French Consumer Code, the consumer normally has a period of 14 days to exercise their right of withdrawal in the context of a distance contract.
However, for digital content provided without a physical medium, the right of withdrawal may be lost when performance begins before the end of the 14-day period, with the consumer’s prior express consent and acknowledgment of the loss of their right of withdrawal.
By confirming the order and requesting immediate access to the plugin download, the consumer customer expressly agrees that performance begins immediately and acknowledges that they waive their right of withdrawal once the download or digital access has been provided.
Article 15 — Legal Guarantees
When the customer is a consumer or a non-professional, they benefit from the applicable legal guarantees, including the legal guarantee of conformity applicable to digital content and services.
These guarantees apply independently of any commercial guarantee that may be offered by the Seller.
Article 16 — Refund

Article 17 — Liability

The Seller may not be held liable in the event of:
- incorrect installation;
- incorrect configuration;
- modification of the source code by the customer or a third party;
- conflict with a third-party theme or plugin;
- hosting failure;
- data loss related to the absence of backup;
- improper use of the plugin;
- temporary interruption of the customer’s website;
- indirect damage, business loss, loss of turnover or operating loss.
The customer is solely responsible for backing up their website, database and files before any installation, modification or update.
Article 18 — Compatibility with WordPress, Themes and Plugins
The plugin is developed to work with WordPress, subject to a compatible technical environment.
The Seller does not guarantee perfect compatibility with all existing themes, page builders, plugins or hosting configurations.
When the customer uses Elementor, WooCommerce, a custom theme or a third-party plugin, it is the customer’s responsibility to check the overall compatibility of their website.
Article 19 — Security
The Seller may publish security updates when a fix is required.
The customer is responsible for:
- keeping WordPress up to date;
- keeping their theme up to date;
- keeping their plugins up to date;
- using secure hosting;
- using strong login credentials;
- making regular backups.
The Seller cannot be held liable for hacking or security incidents originating from an element outside the plugin.
Article 20 — Personal Data
As part of the order, the Seller may collect the data required to process the purchase:
- last name;
- first name;
- company;
- email address;
- billing address;
- order information;
- license key;
- website associated with the license;
- payment history.
This data is used to:
- process the order;
- provide the plugin;
- manage the license;
- provide support;
- issue invoices;
- comply with legal obligations.
The customer has rights of access, rectification and deletion under the conditions provided for by the applicable regulations.

Article 21 — Intellectual Property

Article 22 — Prohibition of Resale and Redistribution
The customer agrees not to:
- sell the plugin to a third party;
- offer the plugin as a free download;
- include the plugin in a commercial offer without authorization when it is redistributed as a standalone product;
- publish the plugin on a public repository;
- share the license key;
- bypass the limitations provided for by the license.
Use within a client project is authorized only if the purchased offer allows it and if the license complies with the authorized number of websites.
Article 23 — License Suspension or Deactivation
The Seller reserves the right to suspend or deactivate a license in the event of:
- fraudulent payment;
- forced refund or abusive bank dispute;
- public sharing of the key;
- attempt to bypass the license system;
- unauthorized redistribution of the plugin;
- abusive use of support;

Article 24 — Force Majeure

Article 26 — Consumer Mediation
For consumer customers, in the event of a dispute that remains unresolved after a written complaint has been sent to the Seller, the customer may use a consumer mediator free of charge.

Article 27 — Applicable Law
These Terms and Conditions are governed by French law.
In the event of a dispute with a professional customer, and unless otherwise provided by law, the competent courts shall be those within the jurisdiction of the Seller.
In the event of a dispute with a consumer customer, the applicable legal rules of territorial jurisdiction shall be respected.
Article 28 — Acceptance of the Terms and Conditions
The customer acknowledges having read, understood and accepted these Terms and Conditions before confirming the order.
Confirmation of the order constitutes full and complete acceptance of these General Terms and Conditions of Sale.
